MARBURY v. MADISON, 1803

"A law repugnant to the Constitution is void."
          Chief Justice Marshall with the Court established judicial review as a role of the Court. Where the constitutionality of a law was challenged, the Supreme Court has the authority to declare the law unconstitutional.

Gibbons v. Ogden, 1824

Federal law is the supreme law were federal law and state law are in conflict.
          In 1824 both Congress and the State of New York had legislation which regulated the steamboat industry. Gibbons had been issued a permit by the federal government to operate his steamboat in the same waters as Ogden, who had been issued a state permit. The Court determined that where the federal law and state law are in conflict, the federal law must prevail.
